KURIAN JOSEPH, C.J.

(1.) The petitioner has filed the writ petition with the following prayers:-

(i) To set aside and quash the orders, dated 23.8.1997 passed by the Board of Directors as contained in letter dated 24.9.1997 contained in Annexure PK to this O.A..

(ii) To set aside and quash the orders dated 15.4.1984 as contained in Annexure PF whereby the penalty of reduction of rank to the post of Store Keeper in the pay scale of 570-1080 has been imposed on the applicant.

(iii) To set aside and quash the orders dated 3.11.1988 as contained in Annexure PI.

(iv) To direct the respondents to re-instate the applicant to his original post of Senior Assistant in the respondent- corporation; with all consequential benefits.

(2.) It is seen from Annexure PK communication dated 24.9.1997 that appeal filed by the petitioner has been considered by the Board of Directors. What is the consideration is not clear from the communication. Therefore, there will be a direction to the respondent to communicate the decision taken by the Board to the petitioner. In case the Board has not considered the matter on merits and with reference to the contentions taken by the petitioner in the appeal, we make it clear that the Board shall consider the same on merits and shall pass a speaking order.
